Improving and adopting Public Procurement Law

 

Organization Transparency – Serbia considers that Government and National Assembly should invest additional effort to consider and adopt Public Procurement Law as soon as possible, in order to start implementing new solutions which secure greater publicity of procedures, savings and more quality protection of public interest. Having in mind that public procurements spend 12 % of gross domestic product, each day of delaying of new solutions' implementation means lose measured in millions of dinars of tax payers, which could be used for other, necessary, purposes.

 

In order to make effects of the new Law to fight against corruption stronger, organization Transparency – Serbia prepared and delivered to parliamentary groups and to Ministry of Finances series of amendments for the purpose of adding them to Government's preposition. By accepting of these amendments possible self-will of procurement entity would be decreased: by determining confidentiality of procurements; by excluding implementation of Law because of using assets from credit; by refusing offers because of badly performed earlier contracts on public procurements; by determining criteria for valuation of offers; and, by changing of contractual obligations during realization of procurement. By accepting of our prepositions anticorruption rules would also be widened, number of information available over Public Procurement Portal would be increased, Commission for Protection of Rights would get firmer guarantee for collecting of data necessary for bringing of decision and implementation of Law would start 45 days earlier than anticipated by Government's preposition of the Law.
